2. joint control

Hoberg & Driesch Group companies have close supply and service relationships. In addition, Hoberg & Driesch GmbH & Co. KG offers centralised departments and services to the group companies. This primarily concerns human resources, IT, financial management, quality control/health and safety at work and accounting. Within the framework of this cooperation, the companies also share personal data.

The companies are then jointly responsible for the processing of personal data in accordance with Article 26 of the European General Data Protection Regulation (GDPR). The Regulation requires companies to agree on a contract setting out their joint liability (a so-called joint and several liability agreement) and to inform data subjects about the content of the agreement.

  • Hoberg & Driesch GmbH & Co. KG has been designated as primarily responsible for all personal data and all processing procedures within the Hoberg & Driesch Group.
  • An individual data protection officer has been appointed as the contact person for data subjects. However, data subjects are free to express their privacy concerns to each group company individually.
  • Both the companies themselves and their employees are bound by the obligation of confidentiality with regard to all personal data.
  • All obligations imposed on companies under the GDPR apply to Hoberg & Driesch GmbH & Co. KG as the primarily responsible party.
  • Other companies will adopt, implement and apply all applicable laws and regulations of Hoberg & Driesch GmbH & Co. KG's data protection and data security provisions and measures.

The sharing of personal data within the Group is based on Article 6(1)(f) of the GDPR in conjunction with Recital 48 of the GDPR.

3. Collection and storage of personal data and how and why we use your data

When you visit our website www.hoberg-driesch.com, your device's browser automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is stored without you having to do anything:

  • The IP address of the requesting computer,
  • The date and time of the request,
  • The name of the file requested and the URL of the file,
  • The website from which the site is accessed (referring URL),
  • The browser used and, if applicable, the operating system of your computer and the name of your access provider.

The log file data will be automatically anonymised after seven days. After this period, it will no longer be possible to trace it back to a specific user.

We process the above data for the following purposes:

  • to ensure the smooth operation of the website,
  • To ensure a comfortable use of our website,
  • to analyse the security and stability of the system; and
  • other administrative purposes.

The legal basis for the processing is Article 6(1), first subparagraph, point (f) of the GDPR. Our legitimate interest is based on the above-mentioned purposes of data collection. Under no circumstances will we use the data collected to draw conclusions about you as an individual.

Cookies

Our websites use so-called cookies. They are stored on your device either temporarily for the duration of your session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit.

Cookies that are necessary to complete an electronic communication process (essential cookies) or to provide certain functions you have requested (functional cookies, e.g. for shopping cart functionality) or to optimise the website (e.g. cookies to measure the audience of a website) are stored pursuant to Article 6(1)(f) of the GDPR, unless another legal basis is specified. 4. Disclosure of information

Your personal data will not be disclosed to third parties for any purposes other than those mentioned below. We will only disclose your personal data to third parties when:

  • such disclosure is necessary for the purposes of compiling legal claims pursuant to Article 6(1), first subparagraph, point (f) of the General Data Protection Regulation,
  • or to defend a legal claim, and there is no reason to believe that you have an overriding legitimate interest in preventing the disclosure of your data,
  • in cases where there is a legal obligation to disclose data pursuant to Article 6(1), first subparagraph, point (c) of the GDPR; and
  • this is permitted by law and necessary under Article 6(1), first subparagraph, point (b) of the GDPR for the performance of a contractual relationship with you.

5. Analysis tools and embedded third-party content

Matomo:
We use the open source Matomo software (formerly "Piwik") to analyse and statistically evaluate the use of our website. We do not use cookies in this context.

This information is used to evaluate the use of our website and to enable its needs-based design. The data will not be disclosed to third parties. Under no circumstances will the results of the analysis be combined with other user-related data.

The monitoring measures we use are based on Article 6(1), first subparagraph, point (f) of the General Data Protection Regulation. By applying these monitoring measures, we aim to ensure the needs-based design and continuous optimisation of our website. We also use the tracking measures to statistically record the use of our website and to optimise our services for you as a user. These interests are considered legitimate within the meaning of the aforementioned provision.

If your browser has the "do not track" function enabled, your visit to our website will not be recorded by means of web tracking.

6. Taking into account tracking blocking and refusal data

We respect the "do not track" function of your browser. When "do not track" is enabled in the browser, tracking is deactivated.

Depending on the browser, the Do Not Track (DNT) option in your web browser is either a button in the program settings or a module that needs to be installed later (add-on or extension). When this option is enabled, your browser sends a signal to our website that you do not want tracking to take place without your explicit consent.   • under Article 15 of the General Data Protection Regulation, to request access to the personal data we process concerning you. In particular, you can request information about the purposes of the processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the envisaged retention period, the right to rectify, erase, restrict or object to processing, the right to lodge a complaint, the origin of your data if we have not collected them, the existence of automated decision-making, such as profiling, and, where applicable, relevant information about their details;
  • under Article 16 of the General Data Protection Regulation, to request without undue delay the rectification or integration of inaccurate or incomplete personal data concerning you;
  • pursuant to Article 17 of the GDPR, request the erasure of personal data concerning you where the processing is not necessary for the exercise of the freedom of expression and information, for compliance with a legal obligation, in the public interest or for the establishment, exercise or defence of legal claims;
  • under Article 18 of the GDPR, to request restriction of the processing of your personal data if you contest the accuracy of the data, if the processing is unlawful but you object to its erasure and if we no longer need the data but you need them to establish, exercise or defend a legal claim, or if you have objected to the processing under Article 21 of the GDPR;
  • under Article 20 of the GDPR, obtain the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format or request the transfer of such data to another controller;
  • to withdraw at any time your previously given consent pursuant to Article 7(3) of the GDPR. As a result, we may no longer continue to process the data based on this consent; and
  • lodge a complaint with a supervisory authority under Article 77 of the GDPR. As a general rule, complaints can be addressed to the supervisory authority of your habitual residence or place of work or to the supervisory authority of our registered office.

8. Right to object

To the extent that your personal data are processed on the basis of legitimate interests in accordance with Article 6(1), first subparagraph, point (f) of the GDPR, you have the right to object to the processing of your personal data on the basis of Article 21 of the GDPR if there are grounds relating to your particular situation or if the objection is directed at direct marketing. In the latter case, you have a general right of objection, which we will exercise without specifying your particular situation.

9. Information security

When you visit our website, we use the commonly used Secure Socket Layer (SSL) procedure together with the highest level of encryption supported by your browser. This is usually 256-bit encryption. The closed image of the key or lock symbol at the bottom of your browser indicates whether an individual page of our website is being transmitted in encrypted form.

In addition, we use appropriate technical and organisational security measures to protect your information against accidental or intentional manipulation, partial or total loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
